Selling

How Long Does Foreclosure Take in Texas?

Short answer

Texas foreclosures are usually non-judicial and can move quickly. For a homestead, the lender generally must give a notice of default with at least 20 days to cure, then a notice of sale at least 21 days before the sale. Sales take place on the first Tuesday of the month at the county courthouse. From first missed payment to sale can be a few months.

The usual sequence

  1. Missed payments. Federal servicing rules generally prevent a foreclosure filing until a loan is more than 120 days delinquent.
  2. Notice of default. At least 20 days to bring the loan current.
  3. Notice of sale. Posted at the courthouse, filed with the county clerk and mailed at least 21 days before the sale.
  4. Foreclosure sale. First Tuesday of the month, between 10 a.m. and 4 p.m.

What you can do

Contact your servicer, ask about loss-mitigation options and talk to a HUD-approved housing counselor. If keeping the house is not realistic, selling before the sale date can protect your equity and your credit. Read selling to avoid foreclosure.
